User Accounts

To use our service, you must create an account through Google OAuth. You are responsible for:

• • All activities that occur under your account
• • Notifying us immediately of any unauthorized use

Content and Conduct

You agree not to upload, generate, or use our service for content that:

• • Is illegal, harmful, or violates any laws
• • Contains explicit, violent, or inappropriate material
• • Infringes on intellectual property rights
• • Contains images of minors without proper consent
• • Is used to create deepfakes or misleading content

Payment Terms

Our service offers both free and paid tiers:

• • Free tier includes limited avatar generations
• • Premium subscription ($9.99/month) provides unlimited generations
• • Payments are processed securely through Stripe
• • Subscriptions auto-renew monthly unless cancelled
• • Refunds are handled according to our refund policy

Intellectual Property

Generated avatars and intellectual property rights:

• • You retain rights to your original uploaded photos
• • Generated avatars are provided for your personal and commercial use
• • You may not resell or redistribute our service or technology
• • Avatarka retains all rights to our platform and AI technology

Limitation of Liability

In no event shall Avatarka, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
